Update on filing Submissions 1 and 2 together for the spouse of a green card holder

If you are filing in September and October 2023, you will need to file Submission 1 and Submission 2 separately in sequence.

Details

For applicants applying as the spouse of a green card holder (called the “F2A” category), usually submission 1 and submission 2 should be submitted separately in sequence. However, because the F2A priority date was “current” until August 2023, if you filed in August 2023 or earlier, in addition to the option of filing submission 1 and submission 2 separately in sequence, you also had the option to file submission 1 and submission 2 together as one package in a single envelope. It’s called concurrent filing.

Starting September 1, 2023, the F2A priority date is no longer “current”, so concurrent filing is no longer an option. The spouse of a green card holder needs to file submission 1 and submission 2 separately in sequence.
